Motion Picture Association Statement on DMCA Review and the Digital Copyright Act of 2021 Discussion Draft

WASHINGTON – The following is a statement by the Motion Picture Association on the discussion draft of the Digital Copyright Act of 2021 released today by the Senate Judiciary Intellectual Property Subcommittee chaired by Senator Thom Tillis:

“The Motion Picture Association commends Senator Tillis and his staff for their work in seeking to address the shortcomings of the Digital Millennium Copyright Act (“DMCA”) in the discussion draft of the Digital Copyright Act of 2021 released today. The Senate Judiciary Subcommittee on Intellectual Property held seven hearings in 2020 on the DMCA, receiving testimony from creators and distributors of copyright works, online service providers, public-interest groups, and academics. The discussion draft constitutes a first effort to find harmony among their many conflicting views. In particular, the MPA is appreciative of the proposals seeking to remedy judicial misinterpretations of Section 512 that have broadened the safe harbor beyond the limits set by Congress in the DMCA.”
